Industry Terms

These Industry Terms govern access to ScriptAccess Select and other restricted discovery services made available to verified or approved industry professionals.

ScriptAccess Select is a controlled discovery environment. Access is for legitimate professional evaluation and commercial consideration, not redistribution or unauthorised exploitation of writers' material.

1. Who may access ScriptAccess Select

Access to ScriptAccess Select may be limited to verified or approved industry professionals whose legitimate professional activities are relevant to Film, Television, Microdrama, Stage or Fiction.

This may include producers, production companies, studios, financiers, distributors, commissioners, filmmakers, publishers, literary agents, theatre producers, agents, managers and other relevant professional users.

ScriptAccess may request information reasonably necessary to verify identity, professional status or legitimate industry purpose before granting or continuing access.

2. Access is personal and limited

Access credentials are personal to the approved user and must not be shared with unauthorised persons.

Users may access work and related material only for genuine professional evaluation, development, representation, financing, acquisition, production, commissioning, publication, performance, adaptation, licensing or other legitimate industry purposes relevant to the form of work concerned.

3. Writer ownership

Writers retain copyright and ownership of their work unless and until rights are transferred or licensed under a separate written agreement.

Access to work through ScriptAccess does not grant the user any ownership interest, licence, option, production right, publication right, performance right, adaptation right or other exploitation right in that work.

4. Confidentiality

Works and related materials made available through ScriptAccess Select are provided for restricted professional consideration.

Users must not disclose, distribute or circulate submitted material outside their organisation or professional team except where reasonably necessary for legitimate evaluation and only to persons who are themselves expected to keep the material confidential.

5. No unauthorised copying or redistribution

Users must not publish, post, upload, sell, sublicense, redistribute or otherwise make submitted work or related material available to the public or to unauthorised third parties.

Reasonable internal copying for legitimate professional evaluation may be permitted, but such copies must remain controlled and confidential.

6. No scraping, harvesting or database extraction

Users must not use automated tools, bots, scripts, crawlers or similar technologies to scrape, harvest, download or extract submitted work, writer information, metadata or other restricted content from ScriptAccess.

Users must not build or contribute to an unauthorised database, archive or commercial dataset derived from ScriptAccess Select.

7. Introductions and originated opportunities

Where ScriptAccess introduces an industry professional to a writer or qualifying work, that introduction may be treated as a ScriptAccess-originated opportunity.

If a commercial transaction arises from that introduction, ScriptAccess may be entitled to a fee, commission, participation or other agreed economic interest under the applicable writer-side, industry-side or transaction-specific agreement.

8. No circumvention

Users must not deliberately bypass ScriptAccess in order to avoid commercial terms attached to an introduction or opportunity originated through ScriptAccess.

Where relevant, the precise scope and duration of any protected introduction or non-circumvention obligation will be set out in a separate agreement.

9. Contacting writers

ScriptAccess may require initial contact, expressions of interest or commercial enquiries concerning Select work to be made through ScriptAccess or through another route specified on the platform.

Users must respect any contact, confidentiality or communication controls communicated in connection with a particular writer or work.

10. No guarantee of availability

ScriptAccess does not guarantee that every work will remain available, that every writer will wish to engage, or that any rights will be available for acquisition, licensing or other commercial exploitation.

Writers may withdraw material, enter into other arrangements or otherwise change the availability of a project.

11. No endorsement or warranty

Inclusion in ScriptAccess Select indicates that a work has satisfied the relevant ScriptAccess selection process. It does not constitute a guarantee of commercial success, production or publication suitability, legal clearance, originality or freedom from third-party claims.

Industry users remain responsible for carrying out their own creative, commercial, legal and due-diligence assessment before entering into any transaction.

12. Professional conduct

Users must engage with writers and other ScriptAccess participants professionally and in good faith.

ScriptAccess may restrict or revoke access where it reasonably believes a user has misused the service, breached confidentiality, behaved improperly, attempted unauthorised exploitation or acted in a way that risks harm to writers, ScriptAccess or other users.

13. Suspension and termination of access

ScriptAccess may suspend, limit or terminate access to Select at any time where necessary to protect the service, writers, submitted material or legitimate commercial interests.

Termination of platform access does not automatically extinguish obligations arising from prior introductions, confidentiality duties or separate commercial agreements.

14. Separate commercial agreements

These Industry Terms govern access and conduct. They do not replace any separate option agreement, purchase agreement, publishing agreement, licensing agreement, representation agreement, commission agreement, introduction agreement, confidentiality agreement or other transaction-specific contract.

Where a separate written agreement applies to a particular opportunity or transaction, that agreement will govern the relevant commercial rights and obligations.

15. Changes to the service

ScriptAccess may refine its verification requirements, access controls, discovery tools, commercial structure or operating procedures as the service develops.

Continued use of restricted industry services may be made subject to updated terms where appropriate.

16. Relationship with the general terms

These Industry Terms supplement the general ScriptAccess Terms & Conditions and any additional terms that apply to a particular service or transaction.

17. Contact

Questions concerning industry access, verification or ScriptAccess Select may be sent through the contact details published on the ScriptAccess website.
